ANALYSIS <br />ROOK 83 PAIJE484, <br />The DER permit has been received; plans and specifications have been <br />prepared in-house. <br />An informational meeting for all property owners in the subject <br />subdivision was held on May 15, 1991. All attendees voiced their <br />enthusiasm for the project and were eagerly awaiting County water <br />service. <br />Approval of the attached Resolution III will confirm the special <br />preliminary assessment. <br />RECOMMENDATION <br />The Department of Utility Services recommends approval of Resolution <br />III and its accompanying preliminary assessment roll. <br />Director Pinto stressed that the people are very anxious to <br />get water; they need it very badly and need it as quickly as <br />possible. <br />The Chairman asked if there was anyone who wished to be <br />heard. <br />Ernest Rovella, 5090 Rosewood Road, brought up the oak tree <br />that is there. He believed if the roots are cut, it may die, and <br />if it did, he was told the residents would be responsible for <br />removal of the tree. He just wished to be on record that someone <br />should be responsible if the tree should die, and he would like <br />to know who would be responsible. <br />Director Pinto believed that because we are going in there <br />with the water, we should take the responsibility of removing the <br />tree if it should die. <br />Commissioner Eggert asked if that included replacing it, and <br />Director Pinto indicated it would, if possible. He noted that <br />this is a very big tree and we are designing around it so he <br />doubted it would be affected. <br />Mr. Rovella brought up the possibility of changing the <br />design and tunneling under his neighbor's concrete driveway to <br />avoid the tree by a greater distance. <br />Director Pinto assured him that we have looked very closely <br />at the design; we are looking at hand digging and using rubber <br />tired equipment; he believed we are doing everything possible. <br />The Chairman having determined that no one else wished to be <br />heard, closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bowman, the Board unanimously adopted <br />Resolution 91-64 confirming the special assessments <br />in connection with a water line installation in <br />Silver Oak Estates. <br />26 <br />
