Richard Sabonjohn to James Chandler <br />received May 30, 1991 <br />DATE: June 4, 1991 FILE: 14stcan.agn <br />DESCRIPTION AND CONDITIONS <br />Mr. Richard Sabonjohn, 1440 3rd Court, has requested staff <br />to investigate the 14th Street Canal Dredging project since <br />it is his opinion that the Contractor, Wally Bailey Dredging <br />Co., Pierson, FL, did not perform the contractual <br />obligations specified in the contract. Staff has researched <br />the matter, and the following analysis is presented: <br />ANALYSIS <br />For analysis purposes, the project is divided into the <br />following categories: <br />1) History of Project <br />In October 1984, the Indian River -Boulevard Phase II <br />consultant and staff met with residents of Rockridge to <br />discuss bridge clearance. At that time, the• boat <br />owners in the group.expressed the need for dredging the <br />canal channel. After Indian River Boulevard was <br />constructed in -1987, the item was discussed by the <br />Board again and funding from the Florida Inland <br />Navigation District and special assessments was <br />considered. Staff was authorized to pursue permitting <br />for the project and apply for FIND funding. The scope <br />of the project involved dredging the canal beneath the <br />new Indian River Boulevard bridge (depth reported to be <br />1.5' in 1988) and dredging a small area near the mouth <br />of the channel where staff identified shoaling. <br />2) Engineering and Permitting <br />Staff applied for "short -form" dredge and fill permits <br />for the project. Florida Statutes Chapter 403.813 <br />provides for this type project if less than 10,000 <br />cubic yards of material is dredged. <br />AN it 1991 <br />On Sept. 30, 1988, staff applied for a DER and US Army <br />Corps of Engineers permit to remove 3,800 cubic yards <br />of material from the canal and Indian River. Since the <br />permit was a maintenance activity, staff described the <br />access channel to be 5' deep in the area to be dredged, <br />based upon communication with persons familiar with the <br />original canal excavation in the 1950's and 19601s.
