JUN it 1991 <br />_I <br />BOOK 8 F°:JE 8 <br />AUTHORIZTN TO FILE SUIT FOR FRANCHISEES TO CONNECT TO WW SYSTEM <br />County Attorney Vitunac reviewed the following: <br />TO: BOARD OF COUNTY COMMISSIONERS <br />u <br />FROM: Charles P. Vitunac, County Attorney <br />DATE: June 5, 1991 <br />RE: REQUEST AUTHORIZATION TO FILE SUIT <br />Countryside North and Reflections on the River are franchisees of <br />Indian River County under franchises which require that these <br />developments connect to the County wastewater system when the system <br />is available. Both developments have been notified by the Utilities <br />Department that the service is available and that connection should be <br />made, and neither group has connected to the system or has agreed to <br />connect to the system. <br />While negotiations are still continuing, the County Attorney's Office <br />requests permission to file suit against both franchisees to enforce the <br />terms of the franchises. <br />Attorney Vitunac advised that he was told Countryside North <br />is probably going to connect because their sale has fallen <br />through. He further noted that he is having a meeting tomorrow <br />with Attorney Brandenburg to negotiate regarding Reflections on <br />the River. <br />Commissioner Eggert felt the Board had given authorization <br />on this matter before, but Commissioner Scurlock advised this <br />item was put on the Agenda just for clarification. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Scurlock, the Board unanimously authorized <br />the County Attorney's Office to file suit as <br />requested above. <br />PARKS & RECREATION COMMITTEE REPORT <br />Chairman Bird went over the following summary: <br />38 <br />
