,ROOK & FAGE 740 <br />Director Keating advised that this is not considered an <br />expansion of the node at Oslo & 27th Ave; this is a redesignation <br />of residential property that is adjacent to the node and a <br />reflection of the fact that right before the transmittal hearing, <br />the applicant sold to the County R/W the County needed on Oslo <br />Road and 27th Avenue, and, therefore, this essentially is moving <br />the boundaries of the node further west to reflect the commercial <br />property the applicant previously had and has since sold to the <br />County. He believed we now have addressed all the DCA's <br />objections and staff recommends approval. <br />The Chairman asked if anyone present wished to be heard. <br />There.were none, and he thereupon closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Scurlock, Commissioners Bowman and Wheeler <br />being absent, the Board unanimously (3-0) adopted <br />Ordinance 91-35 amending the Comp Plan reconfiguring <br />the Oslo/27th Ave. node and changing the Land Use <br />designation from L-2 to C/I and adopted Ordinance <br />91-36 rezoning the subject property to CG as re- <br />quested by the applicant <br />ORDINANCE NO. 91- 35 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />LAND USE ELEMENT OF THE COMPREHENSIVE PLAN AND- THE <br />ACCOMPANYING FUTURE LAND USE MAP BY RECONFIGURING THE OSLO <br />ROAD/27TH AVENUE COMMERCIAL NODE AND AMENDING THE LAND USE <br />DESIGNATION FROM L-2 TO C/I, AND PROVIDING FOR CODIFICATION, <br />REPEAL OF CONFLICTING PROVISIONS, SEVERABILITY AND EFFECTIVE <br />DATE. <br />WHEREAS, the Board of County Commissioners adopted the Indian <br />River County Comprehensive Plan on February 13, 1990, and <br />WHEREAS, the County received comprehensive plan amendment <br />applications during its July, 1990 amendment submittal window, and <br />WHEREAS, the Local Planning Agency held a public hearing on <br />all comprehensive plan amendment requests on November 15, 1990, <br />after due public notice, and <br />WHEREAS, the Local Planning Agency recommended denial of this <br />comprehensive plan amendment to the Board of County Commissioners, <br />and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County held a Transmittal Public Hearing on December 11, 1990, <br />_ 150 _ <br />
