UW -90 -09 -DS <br />BACKGROUND <br />On May A4, 1991, the Indian River County Board of County <br />Commissioners approved Resolutions 91-59 and 91-60, which contained_ <br />the preliminary assessment roll and established the date of the <br />public hearing for the subject project. Property owners have been <br />notified of the public hearing by certified mail. Resolution 91-59 <br />was published in the PRESS JOURNAL on May 20, 1991. <br />ANALYSIS <br />Design of the water distribution system is complete.. Approval of <br />the attached Resolution III will confirm and approve the preliminary <br />assessments. The attached map displays the area to benefit from the <br />assessment project. The project will serve an area bordered by and <br />abutting: 12th Street on the north, 8th Street on the south, 43rd <br />Avenue on the west, and 27th Avenue on the east. This project <br />contains 610 lots, of which 81 originally petitioned ,for water, 32 <br />of which are substandard sized. There are an additional 326 <br />substandard -sized lots. These 407 lots represent 66.8% of the total <br />610 -lot project. Providing water service to these substandard -sized <br />properties is required through the Comprehensive Plan. <br />This assessment cost to the property owners is $827,825.00. The <br />projected cost for construction of the water main lines on 12th and <br />8th Streets and 43rd and 27th Avenues is $314,295.00 but is not <br />included as a part of the assessment cost. The lines on 12th and <br />8th Street and 43rd and 27th Avenues are a part of the master water. <br />transmission system set forth in the Water Master Plan. These lines; <br />are funded as a part of the impact fee. The interior transmission. <br />lines within the project are included in the assessment cost. <br />There are three.potential methods of assessment: square footage, <br />lineal front footage, and per unit. Any one of these methods wild <br />recover the total assessment cost. The most equitable for thel <br />property owners has been proven to be the square footage method.; <br />This method has been and is presently used and recommended by thel <br />Department of Utility Services. It is the only method which has <br />been upheld by the Supreme Court of Florida. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners approve Resolution III, which -affirms <br />the preliminary assessment of the subject project. <br />17 <br />BOOK. 83 <br />
