The property is shown on the <br />proposed future land use map under the AG -1 land use designation <br />which permits one unit per five acres. The Feldmans' request that <br />this designation be changed to a "R" Rural designation which <br />permits one unit per one acre, and that the Urban Service Area <br />Boundary be amended so as to include the Subject Property. <br />The basis for the Feldmans' objection and their request is set <br />forth below: <br />I. THE FELDMANS ARE BEING DENIED DUE 'PROCESS OF LAW <br />UNDER THE FEDERAL AND FLORIDA CONSTITUTIONS BECAUSE <br />THE HEARING PROCESS BEFORE THE BOARD OF COUNTY <br />COMMISSIONERS DOES NOT PERMIT A MEANINGFUL <br />OPPORTUNITY TO BE HEARD ON THE XBRITS OF THEIR <br />9WICTION AND RBOU$ST B <br />Indian River County initially adopted its comprehensive plan <br />on February 13, 1990. As adopted, the plan was acceptable to the <br />Feldmans. Under that plan, the Subject Property was designated <br />"Rural", permitting one single family unit per acre.
