Davis, P.E., <br />Public Works Directo <br />SUBJECT: Request from Contractor James Dupuis for a License <br />Agreement to Allow a Concrete Driveway within a <br />County Unpaved Road Right -of -Way <br />REF. LETTERS James E. Dupuis to County dated June 21, 1991 <br />DATE: June 24, 1991 FILE: dupuis.agn <br />DESCRIPTION AND CONDITIONS <br />James Dupuis, Contractor, has constructed a concrete <br />driveway approximately 15' . within 32nd Avenue SW <br />right-of-way which contains an unpaved road. Past county <br />policy has been that no driveway will be paved within a <br />County right-of-way where an unpaved road exists. The <br />Public Works Department issued Mr. Dupuis a County <br />Right -of -Way Permit application which specifically prohibits <br />the driveway paving within the right-of-way. The <br />Engineering Division Inspector did not recommend that a <br />Certificate of Occupancy be issued until the concrete was <br />removed from the right-of-way. Mr. Dupuis is requesting <br />that the County issue a License Agreement to allow the <br />concrete to remain in County right-of-way and that he would <br />remove it when requested. <br />ALTERNATIVES AND ANALYSIS <br />To staff's knowledge, only once has the County issued a <br />license agreement to allow a paved driveway to exist within <br />the right-of-way containing an unpaved road (Graham <br />Stikelether, licensee). Staff does not recommend that paved <br />driveways be permitted within the right-of-way containing an <br />unpaved road for the following reasons: <br />1) Unpaved roads erode into roadside swales, thereby <br />creating the need for county equipment to re -excavate <br />the drainage swale. The driveways become covered with <br />marl/shell and equipment encounters concrete or <br />pavement. The result is damage to county equipment. <br />2) When the road is paved, the driveways must be excavated <br />and pavement removed so that a proper drainage system <br />can be constructed. <br />3) Graders grading the roadway may possibly hit the <br />pavement causing the grader to jar or bend the blade. <br />The alternatives are as follows: <br />Alternative No. 1 <br />Deny issuance of a License Agreement to allow the <br />driveway to remain and request Mr. Dupuis to remove the <br />pavement within the right-of-way only. <br />Alternative No. 2 <br />Approve issuance of a License Agreement. <br />RECOMMENDATIONS AND FUNDING <br />Alternative No. 1 is recommended. <br />61, <br />43 <br />BOOK :d PAijE � �� <br />
