r <br />BOOK 83 PAU 808- <br />Director <br />08 <br />Director Davis explained that Grovenor Estates is a <br />subdivision of about 206 lots, and in 1985, the Board directed <br />that we address violations in that subdivision for this same <br />issue. At that time staff found there were 27 violations, and <br />after working with the people, out of the 206 lots, there now are <br />only 19 driveways that are paved within the R/W. We have issued <br />one license agreement to Graham Stikelether in the past to allow <br />such a driveway to remain in Clemmons Estates, but staff still <br />feels a driveway should not be paved in a county unpaved R/W for <br />the reasons set out in the above memo. <br />Commissioner Scurlock believed Mr. Dupuis is a contractor <br />and that he has done this before without a permit. <br />Director Davis advised that he had a permit issued, and on <br />the back of the permit, it specifically states that he should not <br />pave out into the R/W. <br />Commissioner Scurlock noted that Mr. Dupuis, therefore, was <br />aware of the restriction, but he went ahead and did it anyway. <br />Commissioner Wheeler did not believe that Jim Dupuis is a <br />contractor, and he believed there was some confusion over the <br />issuance of the permit also. <br />James Dupuis, 32nd Avenue S.W., Grovenor Estates, came be- <br />fore the Board and stated that the driveway was formed up when he <br />called for an inspection, and the inspector came out and signed <br />off on it. He more or less built the house as owner/builder, and <br />he did not know the driveway was not supposed to go past his <br />property line. He has pictures that will show his driveway is <br />not in the way of the grader, and he also has pictures of other <br />driveways in Grovenor Estates that go past the property line. <br />Commissioner Scurlock commented that he was led to believe <br />that Mr. Dupuis had built a number of homes but this apparently <br />is a lot different situation. <br />Mr. Dupuis explained that his father is a contractor, and he <br />just gave him a hand now and then with building his house. <br />Commissioner Eggert believed that his father would have <br />known about this requirement, and she believed Mr. Dupuis was <br />issued a permit, on the back of which there was a reference to <br />that requirement. <br />Chairman Bird asked what hardship would be involved in <br />cutting off the driveway at the property line if that were the <br />wishes of the Board, and Director Davis advised it would just be <br />a matter of sawing the concrete off, removing it, and putting in <br />rock. <br />Commissioner Eggert wished to know just how people are made <br />aware of this requirement, and Director Davis stated that the <br />list of conditions is simply set out on the back of the permit. <br />44 <br />
