r <br />JUL BOOK <br />need for more staff, it would need approval from the Board. <br />Director Galanis explained what we propose to do in a specific <br />operating agreement is to do permitting in utilities and <br />enforcement through the environmental control office, basically. <br />Director Galanis explained that Dr. Bernard Berman would be <br />the overall project director, or local program director. Director <br />Galanis would be the enforcing agent. Permitting revenues would <br />provide some money and fines would be collected and deposited in a <br />pollution recovery trust fund and used to resolve pollution <br />problems, not for salaries or equipment. Commissioner Scurlock <br />stressed the need for proper accounting of funds collected and <br />costs of operation. <br />Chairman Bird summarized what we are doing is agreeing to come <br />up with a suitable agreement to satisfy both parties. If it does <br />not satisfy both parties, we do not enter into the agreement. <br />Chairman Bird suggested we may be getting into a one-way <br />street where the State would not take back the responsibility, but <br />Attorney Collins explained that the statute that allows for the <br />delegation of these programs requires DER to make specific findings <br />that the local program is sufficiently staffed and funded. If they <br />ever make a determination that we are not devoting enough resources <br />to this local program, they are required by the statute to take the <br />permitting funds back and essentially decertify the local program. <br />Commissioner Bowman wished to know if it is true that <br />Environmental Health is no longer doing local restaurant <br />inspections, and Director Galanis explained that he is no longer <br />doing inspections of the restaurants that are licensed by the <br />Department of Business Regulations, which amount to approximately <br />half the restaurants in the County. As a result of this he also <br />lost some staff. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, the Board unanimously approved <br />the Local Program General Agreement with the State <br />of Florida Department of Environmental Regulation <br />and adopted Resolution 91-85 creating a local <br />pollution recovery trust fund. <br />(AGREEMENT NOW RECEIVED AND ON FILE IN THE OFFICE OF CLERK <br />TO THE BOARD) <br />32 <br />
