M <br />River County. We have been negotiating with the DER to <br />assume local program status in concert with the County <br />Utilities Department and the County Community Development <br />Department. It is contemplated that approval of this <br />agreement and later specific operating agreements will <br />assure greater protection of the environment and better <br />service to the community in this county. <br />It should be noted that the agreement allows the DER to <br />divide with Indian River County any civil penalties the <br />DER collects as a result of cooperative enforcement efforts <br />brought in this county. These funds would go into our <br />local Pollution Recovery Trust Fund, to be spent enhancing <br />pollution control activities in Indian River County. <br />Environmental Control Hearing Board civil penalties would <br />be deposited in our Pollution Recovery Trust Fund and spent <br />enhancing pollution control activities and enforcement in <br />Indian River County. As the attached Resolution provides, <br />the expenditure of these funds would be determined by the <br />Board of County Commissioners upon recommendation.of the <br />County Administrator and the County Health Director and <br />the Environmental Control Officer. <br />Environmental Health Director Galanis explained this is the <br />first step. It is called an agreement to agree. It is a general <br />operating agreement for Indian River County to work with the <br />Department of Environmental Regulations. Director Galanis <br />explained this agreement legitimizes what we have been doing for <br />five or ten years and puts on paper the fact that Indian River will <br />be enforcing the rules and approving projects, which will speed up <br />the process. <br />Discussion ensued regarding the types of projects which would <br />be included in the agreement. Mr. Galanis explained each project <br />would be considered in a specific operating agreement. <br />Commissioner Scurlock asked if this means DER is going to allow us <br />to watch ourselves. Mr. Galanis said yes but DER would be watching <br />us; there would be an agreement and it would be monitored. <br />Attorney Collins clarified that there would be rules to <br />follow. The local rules and enforcement programs would have to be <br />as rigid as the program delegated by the state. <br />Commissioner Scurlock and Commissioner Eggert expressed <br />concern regarding staff to run these programs and Director Galanis <br />pointed out that any new staff or any expenditures of funds would <br />come back to the Board for approval. <br />Commissioner Scurlock asked about professional engineers and <br />Director Galanis responded that Robert Wisemen in the Utility <br />Services Department is an environmental. engineer.
