Thompson, P.E.: <br />Capital Projects Manager <br />SUBJECT: Indian River Boulevard Phase III <br />DER Permit No. 311423739 <br />Long -Term Agreement for Exotic Species Removal <br />DATE: July 29, 1991 <br />DESCRIPTION AND CONDITIONS <br />The Department of Environmental Regulation (DER) Permit for <br />construction of Indian River Boulevard Phase III requires <br />that the County submit and have approved a program for <br />removal of Brazilian Pepper and Melaleuca from Impoundment <br />22. In addition, the County is required to enter into a <br />long-term agreement with the DER ensuring that the exotic <br />species removal is .included in perpetuity as part of the <br />management of the impoundment. <br />The attached long-term agreement includes an exotic plant <br />removal plan (Exhibit A) that has been approved by the DER. <br />Specific Condition No. 9 of DER Permit No. 311423739 <br />requires that the County execute this long-term agreement <br />prior to the start of construction. <br />RECONIlMENDATIONS AND FUNDING <br />Staff recommends that the County execute the attached <br />agreement with the DER. Funding from 309 -Indian River <br />Boulevard North. <br />ON MOTION by Commissioner Eggert, seconded by Com- <br />missioner Scurlock, the Board unanimously authorized <br />the Chairman to execute agreement with the DER for <br />permit and removal of exotic species in conjunction <br />with construction of Indian River Boulevard Phase III. <br />PARTIALLY SIGNED COPY OF SAID AGREEMENT IS ON FILE IN THE OFFICE <br />OF CLERK TO THE BOARD. <br />44 <br />
