because the process is costly, time-consuming and causes a hardship <br />on property owners such as the Krovochecks. <br />Mr. Henderson concluded that the staff report is well reasoned <br />and reaches impartial conclusions based upon comprehensive land use <br />and good planning concepts. He felt there was no basis or <br />rationale presented for rezoning the property to RS -1 because the <br />environmental issue will be harshly and critically addressed <br />through the appropriate agencies and had no place in this hearing. <br />Mr. Henderson asked the Board to deny this rezoning. <br />Steve Hall, 915 Second Street, appeared for himself and also <br />representing the associated general contractors. He stated that, <br />historically, staff's recommendations to deny, along with denial by <br />Planning and Zoning, would stop a request for rezoning. He stated <br />that the present zoning falls within the land development <br />regulations and he agreed with staff and Planning and Zoning that <br />this rezoning request should be denied. <br />Nancy Offutt, representing the Vero Beach -Indian River County <br />Board of Realtors, spoke for private property rights. She said <br />that in eight years she had not seen the County sponsor an <br />initiation for rezoning between property owners. Ms. Offutt agreed <br />with Mr. Henderson's suggestion of a workshop to avoid the ordeal <br />and cost for a property owner to go through litigation and protect <br />themselves. She warned that we may find ourselves in any number of <br />cases where the public is vulnerable to rezoning by third parties <br />and cautioned the Board against doing it again. <br />Chairman Bird wished the record to indicate a letter was <br />received from John Luther in favor of the rezoning and another <br />letter was received from Steve Henderson opposing the rezoning, <br />with attachments. <br />Marjorie Krovocheck, 565 South AIA, came before the Board and <br />quoted from the minutes of the County Commission meeting of May 7, <br />1991 in which Mr. John Luther indicated he and his wife agreed to <br />sell Mr. Krovocheck the part he wanted. Mrs. Krovocheck stressed <br />that the Krovochecks have never asked to buy, nor bought, any land <br />from the Luthers at any time. The entire purchase was made from <br />Mrs. Marie Sabonjohn Simmons. Mrs. Krovocheck pointed out at the <br />May 7 meeting Mr. O'Haire had failed to mention the fact that River <br />Ridge Subdivision is also a part of this peninsula. She felt <br />compelled to correct these statements because it was a question of <br />the credibility of Mr. Luther and Mr. O'Haire. Mrs. Krovocheck <br />stated the master land use plan was developed with a great deal of <br />thought by the County and she would not deny the County the option <br />to initiate its own amendment or rezoning proposals.
