� r � <br />There is use by custom or prescriptive rights but the 35 feet that <br />the County is considering acquiring is only surrounded by three <br />pieces of private property. He said that a few years ago, when Mr. <br />Pinto requested it, he gave the County an easement across the back <br />of his property to serve property owners to the south of Home & <br />Patio. If the 35 -foot strip of property were owned by Home & Patio <br />and whoever would be buying the Clock Restaurant, easement.would <br />also be given over that piece of property. He felt the property <br />should be acquired by the people who adjoin it and give the County <br />whatever utility easements they need because the people that are <br />going from Sixth Avenue to U.S. 1 are crossing private property for <br />several hundred feet. <br />Chairman Bird stated that situation will change when the <br />County acquires the two LaCava pieces and the Southgate Mobile Home <br />Park piece. Then it would all be County owned and it would all be <br />public. <br />Mr. Mooney thought the Southgate Mobile Home park property was <br />not for sale at any price. <br />Public Works Director Jim Davis advised that the owner of the <br />Southgate Mobile Home Park property, the senior Mr. Wold, when he <br />was alive, was reluctant to sell. He further advised that staff <br />had not spoken with the heir but plan on doing that once the LaCava <br />property purchase is cleared. <br />Chairman Bird thought we should go ahead and proceed to buy <br />the LaCava property. If we run into a stone wall on the Southgate <br />property and we determine we cannot do what we want, we always have <br />the option of offering this property back to Mr. Mooney and the <br />other abutting property owner. <br />Mr. Mooney questioned the time table. He stated he has been <br />working on this issue for 20 years and he would like to clarify his <br />position. <br />Debra Smith, representing Dependable Dodge, informed the Board <br />that Dependable Dodge has an approved site plan and wondered if <br />there will be any adverse effect if something is worked out with <br />Home & Patio. <br />Chairman Bird responded that the site plan would not be <br />affected by the County acquiring this land. <br />Planning Director Stan Boling demonstrated the locations of the <br />various pieces of property, the proposed configuration of the <br />roadway and the parking spaces related to Home & Patio. <br />THE CHAIRMAN CALLED FOR THE QUESTION <br />It was voted on and carried unanimously. <br />35 <br />AUG' 2 ? 1991 <br />BOOKS <br />
