SEP 10 1991 BOOK 84 F'a. -E 243 <br />We may end up in Court having to give everybody the right not to <br />pay base facility. <br />Commissioner Eggert asked what we told these people during <br />that meeting. <br />Attorney Vitunac said they were told they do not have to pay <br />their impact fee until they actually connect, which could be ten <br />years from now. <br />Commissioner Eggert asked if we told them if they pay the <br />impact fee early they would not have to pay the base facility. <br />Attorney Vitunac recalled that no promises were made; the <br />Board said it would look into it. <br />Commissioner Scurlock did not believe we could have made that <br />assurance because there is going to be a difference in when people <br />connect to the system. <br />Attorney Vitunac mentioned a number of cases in which lawsuits <br />may be filed for unpaid base facility charges) and if the Board were <br />to allow no base facility charge until the lines are in front of <br />the residence, that weakens the County's case. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, the Board unanimously approved <br />the policy of commencing base facility charges when <br />residents reserve capacity and prepay impact fees, <br />as recommended by staff. <br />APPOINTMENT TO TRANSPORTATION DISADVANTAGED LOCAL COORDINATING <br />BOARD <br />Commissioner Bowman reported an opening on the Transportation <br />Disadvantaged Local Coordinating Board for a disabled <br />representative. Council on Aging recommended Mr. McGehee. He was <br />asked to submit a resume but has not done so. Commissioner Bowman <br />said she received a letter from Mrs. Mae Arnold giving a resume of <br />her expertise and she seems to be very well qualified. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously appointed <br />Mrs. Mae Arnold to the Transportation Disadvantaged <br />Local Coordinating Board. <br />28 <br />
