Bird: <br />I have been advised by a group of citizens who own property <br />south of CR 512 and•east•of 130 Avenue, that this group will <br />be attending the September 17 meeting to discuss problems <br />with roads in that area. <br />I would' like to enlighten you on this problem from the <br />Districts point of view if I may. <br />On the tax rolls it appears that 130 avenue (Willow Street) <br />is a canal right-of-way. According to the original platt <br />(see enclosed copy) 130 Avenue (Willow Street) is actually <br />a 30 foot road right-of-way. <br />As you are aware there is an inter -governmental agreement <br />between this District and the County concerning grading of <br />certain roads as described in that agreement. 130 Avenue <br />is included in that agreement south to ditch 22 (81 Street) <br />Being a chapter 298 Water Control District, the sole <br />function and sole authority is to carry out drainage and <br />water control operations within its boundaries and nothing <br />else. <br />The District does not now or has never owned a road grader <br />V and has never done any road construction or maintenance in <br />its 72 years of existence, and cannot in fact or it would <br />be in violation of its charter. <br />All work done in the past and present, that the public might <br />have assumed as done by the District, was done by or is <br />being done by the county or as a public service by large <br />landowners within the Di.ptrict and even individuals, but not <br />by the District. Some of this misunderstanding is because <br />of the Limited Dedication (see enclosures) granted by the <br />original developer on the recorded plats to permit public <br />roads on certain of the right-of-ways, where they would not <br />interfere with primary functioning of the water control <br />system. <br />The entire Public Facilities as reported to the county and <br />state as required by law consists soley of the canal system <br />as described in the Plan of Reclamation.. The district does <br />not ownculvertsor bridges or supply them. They are owned <br />by the landowner, county or city. This District permits <br />these structures in and over the system. <br />I hope this helps you better understand this District and <br />if I can be of any further help to you please advise. <br />14 <br />
