He did think <br />the area was certainly in distress right now with all the bad <br />publicity it has received and he would hate to put another nail <br />in the coffin by initiating a disincorporation of the Town during <br />this period of turmoil. <br />Commissioner Eggert felt that this could become a whole <br />different thing which may or may not be a residential <br />development. <br />Commissioner Wheeler's concern was if another company or <br />large corporation comes in and tries to increase height <br />restrictions, densities, etc., and Attorney Vitunac advised that <br />they still would have to comply with the Town's Comp Plan <br />requirements regarding infrastructure, limitations on the bridge <br />and AIA, etc. <br />Commissioner Scurlock added that there are 104 people who <br />have bought lots and have deed restrictions on their property <br />titles saying that is a residential development with a beach <br />club, etc. He emphasized that while the major property owner is <br />the developer, those 104 people now make up the population even <br />though most of them are not permanent residents who can vote. <br />Attorney Vitunac pointed out that eligible voters would have <br />one vote per lot, whether it is an average lot or a parcel. <br />Commissioner Wheeler asked what the approach would be <br />regarding the Town of Orchid, and Chairman Bird wanted to see us <br />take the same approach as with Fellsmere, that they take it to <br />their Town Council first. <br />Commissioner Eggert advised that any special act had to be <br />filed fairly quickly because this is something that would have to <br />go to the Legislative Delegation, but Chairman Bird didn't feel <br />that the Town of Orchid was going to want to disincorporate. <br />Commissioner Eggert advised that she needs to get back to <br />Representative Sembler on the feeling of the Board on the disin- <br />corporat'ion of the. Town of Orchid because this is something that <br />Representative Sembler has been contacted about. <br />As one Commissioner, Chairman Bird wasn't in favor of doing• <br />anything to initiate the disincorporation unless we hear from the <br />residents and the Town's Council that is what they want. He felt <br />it is a different situation than Fellsmere where we are hearing <br />that the residents want disincorporation. <br />Commissioner Scurlock wished to have more time to think <br />about this before making any decision, and Commissioner Wheeler <br />wished to communicate with the Town of Orchid about this as he <br />has some grave concerns. He recalled that 3 or 4 years ago we <br />asked the Legislative Delegation to consider the disincorporation <br />of the Town of Orchid, but it fell on completely stone•.deaf ears. <br />35 <br />SEP 17 IW <br />
