McCoy, AICP da h <br />Senior Planner, Current Development <br />DATE: September 11, 1991 <br />SUBJECT: Indian River County's Request for Special Exception <br />Approval ,to Construct an Expansion of the North Beach <br />(Sea Oaks) Wastewater Treatment Plant <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of September 24, 1991. <br />DESCRIPTION AND CONDITIONS: <br />Kimball Lloyd and Associates, Inc. has submitted a major site plan <br />and special exception use application to construct a wastewater <br />treatment plant expansion at 8767 S.R. A.1.A. The property is <br />zoned RM -6 (Multi -family up to 6 units/acre), and is located south <br />of and adjacent to the Sea Oaks development. The site contains an <br />existing wastewater treatment plant which the County acquired from <br />Sea Oaks Communities, Inc. The plant serves the north beach area. <br />As proposed, the expansion will increase the plant's capacity from <br />0.28 million gallons per day (MGD) to 0.8 MGD. The expansion of a <br />limited utility use in the RM -6 district requires special exception <br />use approval by the Board of County Commissioners. <br />This application was reviewed under the old land development <br />regulations (LDRs), as the application was submitted prior to the <br />adoption of the County's new LDRs on September 11, 1990. However, <br />the applicant has agreed to and is meeting the specific land use <br />criteria in Chapter 971 of the new land development regulations. <br />The Board of County Commissioners is to approve, approve with <br />conditions, or deny the special exception use request. Pursuant to <br />Section 971.05 the Board of County Commissioners is to consider the <br />appropriateness of the requested use based on the submitted site <br />plan and the suitability of the site for that use. The County may <br />attach any conditions and safeguards necessary to mitigate impacts <br />and to ensure compatibility of the use with the surrounding area. <br />At its August 22, 1991 meeting the Planning and Zoning Commission <br />recommended unanimously that the Board of County Commissioners <br />grant special exception approval for the wastewater treatment plant <br />expansion. The major site plan was approved by the Planning and <br />Zoning Commission, subject to the special exception use approval by <br />the Board of County Commissioners. Thus, if the Board of County <br />Commissioners approves the special exception use then the site plan <br />will be in effect. <br />20 <br />
