Rison Staff Planner, Current Development DATE: October 7, 1991 SUBJECT: REDUCTION OF EASEMENT: Frank S. Liggieri Retained Easement from Sunshine Quality Homes - Unit 2 Plat Vacation It is requested that the data herein presented be given formal consideration by the Board of County Commissioners at its regular meeting of October 15, 1991. DESCRIPTION AND CONDITIONS: On March '6, 1990 the Board of County Commissioners adopted Resolution No. 90-31 which effectively vacated the Plat of Sunshine Quality Homes - Unit 2. The adopted resolution retained a drainage and utility easement over the platted, and now vacated, road rights-of-way until.such time as the property was to be replatted or site planned. Upon such approval, alternative drainage and utility easement(s) over the property would then be approved by resolution by the Board of County Commissioners. (Please see Attachment 1.) On September 12, 1991, the Planning and Zoning Commission approved a 4 - unit apartment building and parking as a major site plan on the subject property. The approved site -plan is the first phase of a larger project the owner intends to develop on the site at a later time. Now that the site has received site plan approval, the applicant and the county are now able to determine a workable, alternate easement arrangement to accommodate both existing lines and needed future service. Peterson and Votapka, Inc. on behalf of Frank Liggieri, is now requesting the original retained easement be reduced to twenty-five (25) feet wide, as depicted on Attachment 2. 21 BOOK PA �0,Ja. ®C � _ 199
