Fr_ I-,- <br />2 2 <br />NOOK <br />ALTERNATIVES AND ANALYSIS: <br />This request has been reviewed by Southern Bell Telephone Company, <br />Florida Power & Light Company, United Artist Cable Corporation, the <br />Indian River County Utilities Department and the Road & Bridge and <br />Engineering Divisions. Based upon their Reviews, staff has <br />determined that the subject easements can be released with no <br />adverse effects if a new 15 foot easement is established. <br />In order to reconfigure the referenced lots, the applicants must <br />record a Unity of Title for Lot 12 and the north 25 feet of Lot 13, <br />and a separate unity'of title for the south 100.63 feet of Lot 13 <br />and the north 30 feet of Lot 14. This is necessary to combine the <br />added portions of each lot into a single parcel for each. <br />Further, the applicants must establish and record a new utility <br />easement to serve the functions to the easements to be abandoned. <br />This new easement shall be a (15) foot utility easement, more <br />particularly described as the south (15) feet of the north 37 1/2 <br />feet of Lot 14, Replat of Bent Pine subdivision, Units 3 & 4, <br />Section 15, Township 32 South, Range 39 East, Indian River <br />County, Florida; according to the plat thereof recorded in Plat <br />Book II, Pages 9, .9A, and 9-B, of the Public Records of Indian <br />River County, Florida. <br />,.It �is staff's position that the referenced easements can be <br />abandoned by the Board with the condition that the abandonment <br />resolution not be executed until the.Unity_, of Title and new <br />easement documents are recorded by the applicants and determined <br />acceptable by the County attorney. <br />RECOMMENDATION: <br />Staff recommends that the Board adopt the attached resolution to <br />release the common seven and one-half (7 1/2) side lot utility <br />easements, being the southerly seven and one-half (7 1/2) feet of <br />Lot 12, the northerly seven and one-half (7 1/2) feet of Lot 13, <br />the southerly seven and one-half (7 1/2) feet of Lot 13, and the <br />northerly seven and one-half (7 1/2) feet of Lot 14, Replat of Bent <br />Pine Subdivision, Units No. 3 and No. 4; Section 15, Township 32 <br />South, Range 39 East Plat Book 11, Pages 9, 9-A & 9-B, of the <br />Public.Records.of Indian River, County, Florida. <br />,Staff also recommends that the attached resolution not be executed <br />until the applicants have recorded a Unity of Title for Lot 12 and <br />the north 25 feet of Lot 13; recorded a Unity of Title for the <br />south 100.63 feet of Lot 13 and the north 30 feet of Lot 14; and <br />record a utility easement over the south 15 feet of the north 37 <br />1/2 feet of.Lot 14. <br />12 <br />W <br />
