Prosect Proposal <br />The applicant filed for administrative permit approval to change <br />the use of an existing home to a child care facility. As required <br />in section 914.04(1) (b) and (c) of the site plan chapter o -f the <br />county's LDRs, all developments proposing a change of use or <br />requiring administrative permit use approval must file for and <br />obtain site plan approval. In conjunction with the administrative <br />permit request, the applicant also submitted a minor site plan <br />application which has been reviewed by the Technical Review <br />Committee (TRC). <br />In his response to a TRC discrepancy letter, the applicant <br />requested that several substantive sections of thewLDRs bever,n" aived" <br />(please see attachment #4). There are, <br />legal <br />provisions for waiving the requirements that the applicant wishes <br />to be waived. These requirements are basic to properly <br />establishing the requested use and are standards that are equitably <br />applied to all other developers of similar projects. According to <br />the county attorney's office, granting such waivers would not be <br />legal (see attachment #5). <br />The applicant requested that regulations requiring the following <br />not be applied with respect to his project: <br />* paved parking and driveway improvements <br />* drainage and stormwater improvements, especially as <br />related to required paved driveway and parking <br />areas <br />* payment of traffic impact fees <br />The applicant was informed by .the staff through the TRC review <br />process that all of the items listed above are improvements <br />required by the code, and that the proposed site plan to tmeet <br />all applicable LDRs. Staff also informed the applicant <br />the <br />site plan was not ready or "ripe" for Planning & Zoning <br />o in in Commission <br />n <br />consideration. - The applicant, as pe <br />Becti <br />914.06(5)(e)l of the site plan chapter, requested that the <br />application request, as submitted, be forwarded for consideration <br />by the Planning and Zoning Commission.
