� � s <br />Commissioner Scurlock asked whether the Army Corps of <br />Engineers did an inventory of the property. <br />Mr. DeBlois stated that they were called to the site before <br />the actual bank work had been done and noted the exotic species to <br />be removed. <br />Commissioner Scurlock noted that mixed in with the Brazilian <br />pepper trees were mangroves, which were removed in the process of <br />removing the exotic plants. <br />Mr. DeBlois recounted the reason the County was called was <br />because the Rockridge residents were contending mangroves had been <br />removed from areas that were not Mr. Schlitt's property. Staff <br />felt that since Mr. Schlitt had gone off his property and did some <br />work in the area under County jurisdiction, he does need to get an <br />after -the -fact permit. Another point Rockridge residents have <br />raised is the matter of removal of mature vegetation which served <br />as a buffer. Staff's finding is that the buffer was largely the <br />Brazilian pepper, expect for the remaining mangrove. In fact, if <br />. Mr. Schlitt had come in, we would have permitted the removal of the <br />Brazilian pepper. <br />Commissioner Scurlock believed that if the site were totally <br />in the County we would promote buffering. <br />Mr. DeBlois agreed and added that the City of Vero Beach also <br />has buffer requirements; however, those requirements are linked to <br />the site development. Mr. Schlitt plans to develop in 1992. <br />Chairman Bird asked if staff had resolved the jurisdictional <br />question. <br />Deputy County Attorney Will Collins stated there are two - <br />issues. The County has no standing to get an injunction against <br />the activity because we have no property interest. As far as <br />regulation of the land, the County can regulate land where it does <br />not have any property interest by virtue of a plat dedication. We <br />can apply regulations within land that falls within County <br />jurisdiction. To the extent that Mr. Schlitt went south of his <br />property line onto the canal bank, we can seek to get an after -the - <br />fact permit for the removal of that Brazilian pepper. <br />Commissioner Bowman understood Mr. Schlitt's property line is <br />about 25 feet north of the canal and therefore he did encroach upon <br />County property. <br />Community Development Director Bob Keating clarif ied it is not <br />County property, it is County jurisdiction. He further explained <br />that an ironic fact is that if Mr. Schlitt had come in early in the <br />process and said, "I want a permit to clear that property, if we <br />would have asked him if he owned it and he would have had to get <br />39 <br />1991, <br />Boor 64k FA;,E 6 <br />J <br />
