Bou <br />FLOOD PLAIN REGULATIONS <br />'Commissioner Bowman stated the flood plain regulations are <br />playing havoc with some people. She referred to a resident of Vero <br />Lake Estates who is required to build a retention pond because her <br />property is more than one acre. Commissioner Bowman said the size <br />of the retention pond would equal the footprint of the building and <br />make her land absolutely useless. The area is wooded and the <br />resident does not want to destroy the trees in order to put in a <br />retention pond. <br />Chairman Bird said some of the Federal Emergency Management <br />Agency (FEMA) requirements were questionable; Commissioners Eggert <br />and Wheeler agreed. <br />Community Development Director Bob Keating stated he could <br />address the issue as it relates to the cut and fill balance <br />requirement in our LDRs. Currently we are exempting lots under <br />half an acre; the new exemption will be lots under one acre. This <br />is based on the fact that the requirements that were applied on <br />small lots can be covered by the new stormwater utility when that <br />is put into effect. <br />Public Works Director Jim Davis directed the Board's attention <br />to the Federal Emergency Management Agency document which explains <br />the management regulations adopted by a community should have <br />certain requirements. However, the language of the document is not <br />mandatory; therefore we have exemptions, among which is the waiver <br />for lots under an acre. Mr. Davis further explained we have <br />limited outfall capacity in the western parts of the County and not <br />filling that flood plain is in the interest of all the people in <br />the watershed area. So, if the lot is in the 100 -year flood plain <br />and it is determined through FEMA modeling that flood water is <br />going to be stored in that area during a 100 -year storm, if the lot _. <br />is over one acre, the new LDRs will not change the cut and f ill <br />balance requirements. <br />Chairman Bird asked if there is any flexibility in that <br />requirement. <br />Director Davis responded that it is not mandatory. <br />Discussion ensued regarding the reasoning behind labeling <br />certain areas "flood prone" when they seem to be high and dry. <br />Director Davis explained that the modeling determines the <br />action of water during a 100 -year storm and decisions are made <br />accordingly. <br />Melody Manning, 7925 92nd Avenue, came before the Board and <br />described the lot with which she is concerned, which is over an <br />acre'but not an acre and a quarter even though it is described as <br />an acre and a quarter.
