In the area in question sub -laterals 19 (87th Street) & 21 <br />(83rd Street) would go west one half mile and then need a <br />culvert to change to the other side for the next half mile. <br />7. The Fellsmere Water Control District is a Florida Statute <br />Chapter 298 Single Purpose Water Control District and as <br />such its responsibility is to provide primary drainage and <br />nothing else. The District has not, does not or will not <br />build roads since it would be in violation of Chapter 298. <br />The District reserves unto itself the fee simple title in <br />and to said right-of-way, together with the right at'any <br />time reserved unto the District to alter or construct - <br />canals, ditches, drains and other drainage facilities <br />thereon and therein as may be necessary and proper from <br />time to time to carry out the objectives and purposes of <br />said District and its Plan of Reclamation. <br />B. The Landowners east of 130th Avenue already are dissatisfied <br />about roads in that area. To add to this problem should <br />really make them happy. The District very frequently has <br />to explain why it is not involved with roads and that it is <br />not involved with impact fees or ad -valorem taxes>to <br />maintain them. <br />9. The school system would have to send buses down <br />he.'new <br />roads and the postal service mail vehicles. T ese_:,roads <br />will not be covered by the inter -governmental that now <br />exist between the District and County and therefore',will <br />not be graded by the county. <br />The District realizes that the tracts can now be sold as 10' <br />acre parcels having 88 possible homes and the problems above <br />will still exist. There are some very large homes that exist <br />now that are,in the 100 thousand and above range, as the west <br />tract develops there will be more homes in this range. <br />Does the staff and Commission want to take complaints from all <br />the homeowners in the area and not provide roads and <br />maintenance. <br />In conclusion, taking into consideration all of the above, the. <br />Fell•smere Water Control District feels the county should create; <br />a special taxing entity to fund building and maintaining Lthese <br />roads or the property owners a property owners associationto do the <br />same,,taking into consideration the paramount rights of -'the <br />District. <br />NO 1 1991 <br />57 <br />nor 64 FA,E 1 ju' <br />
