Box 438 <br />Fellsmere, Florida 32948 <br />RE: Development of Rahn & Other Properties Within <br />Fellsmere Water Control District. <br />Dear Rodney: <br />With reference to our previous correspondence, conferences, <br />discussions, and our recent meeting with members of the County <br />Planing and Zoning, and County Public Works Department (i.e. Mr. <br />Keating, Mr. Boling, Ms. Cherl Tworek and Mr. Davis), pertaining <br />to above referenced matter, I am listing below my thoughts and <br />suggestions, as to the position the Fellsmere Water Control <br />District should maintain. <br />1). First and foremost it must be understood that the F.W.C.D. <br />is a single -purpose District created under Florida State <br />Chapter 298 for the purpose of providing primary drainage to <br />landowners and development abutting the District's sub - <br />lateral and lateral ditches. <br />2). The existing sub -lateral ditches are inconsistently located <br />within the platted rights-of-way. The platted right-of-way <br />widths vary from 40' to 60' in width with a majority being <br />the smaller width. After years of maintenance the top width <br />of these ditches average about 30' in width. The varying <br />location of the sub -lateral ditches located within the <br />narrow rights-of-way often results in the encroachment of <br />maintenance berm way and/or existing adjacent roads on <br />adjoining private property. <br />xxx.REC <br />58 <br />L lI SAA ing Florida <br />Si1nr iml <br />
