The lands to the west would then be adjacent to higher <br />density residential development with no physical separation or <br />buffering, and the owners of this land would probably also request <br />redesignation to a higher density. <br />-,,,Potential Impact on Environmental Quality <br />The subject property is located within floodplain zone AE. <br />Conservation Policy 4.3 of the Comprehensive Plan states that the <br />lands within flood prone areas shall have a low residential <br />density, up to three units to the acre. If the subject property's <br />land use designation' -was changed to 1 dwelling unit to the acre, <br />the subject property's land use designation would not be <br />inconsistent with Conservation Policy 4.3. <br />.,Staff's concern, however, is that any potential increase in the <br />allowable residential density in a floodplain can cause problems. <br />An increase in density generally increases the amount of impervious <br />surface and the potential hazard for flooding. For that reason, <br />development should be directed to upland areas outside of the 100 <br />year floodplain, whenever possible, with development densities <br />severely restricted for floodplain sites. }r <br />Consistency with the Comprehensive Plans:. <br />wR; <br />Land use amendment requests are reviewed for consistency with all,~"s*� <br />policies of the comprehensive plan. As per section 800.07(l) ofk, <br />a rfi; the County Code, the "Comprehensive Plan may only be amended in <br />r, ®R-, such a way as to preserve the.internal consistency of the plan' <br />pursuant to Section 163.3177(2)F.S." Amendments, must also show'' <br />' consistency with the overall designation of land uses -as depicted. <br />4;{ on the -Future Land Use Map, which includes agricultural,` <br />residential, v recreation, conservation, and commercial and <br />industrial land uses and their densities. <br />The goals, objectives and policies are the most ' important parts of''SFr� <br />the Comprehensive Plan. Policies are statements in the plan which ,u� ' <br />' identify the actions which the county will take in order to direct ` <br />by <br />the community's development. As courses of action committed to <br />the county, policies provide the basis for all county land <br />development related decisions - including plan amendment decisions. <br />While all comprehensive plan policies are important, some have more <br />applicability than others in reviewing plan amendment requests. Of <br />particular applicability are the following policies. �a <br />-Future Land Use Policy 13.3 " s <br />In evaluating a land use amendment request, the most important <br />x_ <br />consideration is Future Land Use Element Policy 13.3. This policy <br />requires that one of three criteria be met in order to approve a <br />land use amendment request. These criteria are: <br />* a mistake in the approved comprehensive plan <br />* an oversight in the approved comprehensive plan, or <br />. ..-.. .. � } l 1 ! JL t.C_ ]+..•--LLQ <br />a substantial change In circumstances aLLectin L11C - <br />subject property <br />Based upon staff determination, the subject land use amendment <br />request does not meet any of the three criteria as stated above. <br />The first two criteria allow the county to approve a request to <br />amend the land use map only if a mistake or oversight was made <br />duririq plan preparation, adoption, or amendment. In this case, the <br />subject property's land use designation was changed by the plan <br />amendment adopted to implement the county/DCA compliance agreement. <br />72 <br />
