ASH <br />hPREPARED BY: ASSISTANT DIREt6 OR OF UTILITY SERVICES <br />-SUBJECT: RIVERWALK UTILITIES, INC., WATER AND WASTEWATER SYSTEM <br />FRANCHISE <br />.BACKGROUND: <br />Indian River County granted a water and wastewater -franchise to <br />Riverwalk Utilities, Inc., (RUI) on February 6, 1985-, to provide <br />water and wastewater service to the Riverwalk=Shopping Center. <br />Section XVI, Item 4, calls for the utility to connect to a Couhty- <br />water and wastewater system , if the- County provides a public <br />system. <br />"'The' .County'ha's constructed the North County Wastewater system and <br />fhas-'requested that. -Riverwalk Utilities connect to the County system <br />�.andCy,d�,issolve the Riverwalk Utilities, Inc., franchise. <br />.After -much discussion and negotiation, the Utilities Department -and-- <br />.Riverwalk Utilities, Inc., have agreed on the connection of <br />:.Riverwalk Utilities, Inc., into the County system. under the terms <br />'%and conditions set forth in the attached agreement: <br />Under_the terms of the franchise agreement, RUI has paid and Indian <br />River' County has escrowed water and wastewater impact fees in the <br />:.amount of $176,860.00 for 74 ERUs of capacity. All escrowed funds <br />transfer to Indian River County upon termination of the franchise. <br />Upon execution of an easement between the Developer and the County <br />for operation and maintenance of the water plant, the franchise <br />agreement shall be terminated. <br />RECOMMENDATION• <br />The staff of the Department of Utility Services recommends approval <br />of the proposed agreement with Sebastian Associates,-- Inc., <br />(Riverwalk Utilities, Inc,) and authorization for the Chairman to <br />execute the Agreement. <br />94 <br />
