, <br />JAW (0 7 1992 800 S5 FhE i6 <br />Development Regulation Amendments adopted by the Board of County <br />Commissioners on December 4, 1991. A waiver may now be granted for <br />projects located in the St. Johns Marsh where certain soil types <br />exist as identified by the Soil Conservation Service soil survey <br />maps and all other Chapter 930 requirements are met and no material <br />adverse impact on flood protection is created. <br />ALTERNATIVES AND ANALYSIS <br />The Site Plan has met all the Chapter 930 requirements except the <br />cut and fill balance. The applicant has provided information from <br />the S.J.R.W.M.D. - Army Corps of Engineers Upper St. Johns River <br />Basin Project that predicts that upon completion of the flood <br />control improvements currently under construction, the 100 year <br />floodplain stage at the site will be reduced to about one and one <br />half feet below the base flood elevation indicated on the current <br />F.E.M.A. Flood Insurance Rate Maps. The soil types existing at the <br />site are Holopaw fine sand, Delray muck, and Terra Ceia muck. All <br />three of these soils are included in the waiver criteria. If a <br />waiver is not granted the site could be re -designed to elevate the <br />wastewater treatment plant on piling foundations or additional <br />property could be acquired to relocate at another site in the <br />floodplain with suitable soils for creating a cut and fill balance. <br />Alternative No. 1 - Grant the cut and fill balance waiver based on <br />the criteria of Section 930.07(2)(d)3. <br />Alternative No. 2 - Deny the cut and fill waiver. This would <br />prevent the project from obtaining the required Type B Flood <br />Protection - Stormwater Management System permit needed to fulfill <br />the conditions of the Planning & Zoning Commission Site Plan <br />Approval without redesign or relocation of the wastewater treatment <br />plant. <br />RECOMMENDATION <br />Staff recommends approval of Alternative No. 1. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously approved staff's <br />recommendation of Alternate No. 1 to grant the cut and <br />fill balance waiver based on the criteria of Section <br />930.07 (2) (d) 3. <br />E. Termination of Contract -- IRC and CONTEL <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously approved the <br />Termination of Contract with CONTEL to provide NOAA <br />weather wire information to the County.
