ON MOTION by Commissioner Scurlock, SECONDED by Commissioner Bird, the Board unanimously adopted Resolution 92-2, choosing the Vero Beach Press Journal in which legal and official advertisements will be published from February, 1992, through January 31, 1993. RESOLUTION NO. 92- 2 A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, PURSUANT TO SECTION 197.402, FLORIDA STATUTES, CHOOSING A NEWSPAPER IN WHICH LEGAL AND OFFICIAL ADVERTISEMENTS WILL BE PUBLISHED FROM FEBRUARY, 1992, THROUGH JANUARY 31, 1993. WHEREAS, Section 197.402, Florida Statutes, requires that when legal advertisements are needed the Board of County Commissioners shall select a newspaper as provided in Chapter 50, Florida Statutes; and WHEREAS, Rule 12-D-13.036 (1) , Florida Administrative Code, implies that this choosing of a newspaper shall be performed annually; and WHEREAS, this Rule directs explicitly that at the first Board meeting in February the Board of County Commissioners shall select the newspaper in which said advertisements shall be placed; and WHEREAS, .Section 50.11, Florida Statutes, sets out certain criteria for the publication to be a qualified advertiser for legal and official notices; and WHEREAS, these qualifications include that: 1. The newspaper must be printed and published once a week or more often. 2. The newspaper must contain at least 25% of its words in the in the English language. 3. The newspaper must be admitted and entered as second-class mail at a post office. 4. The newspaper must be for sale to the public generally. ` 5. The .newspaper must be available to the public generally for the publication of official or other notices and customarily containing information of a public character or of interest or value to the residents or owners of property in the county where published or of interest or value to the general public.; JAN 07 492 13 � �} 8 nor ''l� Fr U- F.
