L <br />:iJAN (07 A92 <br />Section 50. 011, Florida Statutes, sets out the requirements for the <br />newspaper, which are generally that the publication be available once a <br />week, or more often, containing at least 25% of its words in English, <br />qualified to be second-class matter at a post office, for sale to the <br />public generally, available to the public generally for the publication of <br />official business notices, and customarily containing information of the <br />public character or of interest or of value to the residents or owners of <br />property in the county where published. <br />The Vero Beach Press Journal and -the Sebastian Sun certainly meet <br />these qualifications and arguably the Miami Herald and the Today <br />newspaper do also. <br />Recommended Action: That the Board choose a newspaper for the 1992 <br />calendar year into which legal advertisements may be placed and <br />authorize the adoption and execution of the attached resolution. <br />Chairman Eggert wanted this item removed for discussion <br />because it doesn't designate a specific newspaper. <br />Attorney Vitunac felt that both the Vero Beach Press Journal <br />and the Sebastian Sun meet the criteria. The newspaper has to be <br />published weekly or more often. He felt the Miami Herald may or <br />may not, depending on how you look at the criteria. It is not <br />actually published in this county, but it is distributed here. The <br />question is whether people look to that paper for their local news. <br />Commissioner Bowman noted that the Miami Herald no longer <br />carries an Indian River section. <br />Commissioner Scurlock questioned whether the Sebastian Sun <br />would reach enough people and asked if we have an ability to split <br />the advertising of public notices. <br />Attorney Vitunac advised that we have the ability to publish <br />in both papers, but there has to be only one that would satisfy the <br />law. For the County Legal Department it is much more convenient to <br />have a paper that publishes daily because some publication <br />deadlines are very hard to meet in a paper that publishes only once <br />a week. <br />12 <br />
