Rison Cpv-, <br />Staff Planner, Current Development <br />DATE: January 6, 1992 <br />SUBJECT: The Community Development Director's Appeal of the <br />Planning and Zoning Commission's Decision to Allow the <br />Use of Road Names for the Rosewood Court Subdivision <br />SD -91-11-014 <br />#91090025 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners gt.its regular <br />meeting of January 14, 1992. <br />Backaround and History: <br />On November 14, 1991, the Planning and Zoning Commission approved <br />a preliminary subdivision plat submitted by Tashkede Properties to <br />develop a 37 lot residential subdivision. Designated street <br />numbers were initially assigned for the subdivision's roadways, in <br />compliance with LDR Chapter 951. The applicant then appealed the <br />requirement to utilize street number designations to the Planning <br />and Zoning Commission; the applicant wishes to use road names <br />rather than road numbers. The Planning and Zoning Commission voted <br />4 to 3 in favor of permitting the Rosewood Court Subdivision to <br />utilize road name designations. (Please see Attachment #4). In the <br />Post -meeting action letter sent to the applicant from staff, staff <br />reserved the right to appeal the Commission's decision to the Board <br />at a later date. <br />Pursuant to Section 902.07(5) of the county's Land Development <br />Regulations, the applicant, the' county administration or any <br />department thereof may appeal an action of the Planning and Zoning <br />Commission to the Board of County Commissioners for its review. <br />While staff has seldom appealed Planning and Zoning Commission <br />action in the past, the appeal authority was incorporated into the <br />LDR's to provide a mechanism for the Board to consider certain <br />Planning and Zoning Commission actions that otherwise would be <br />final. It is staff's position that this case, and the road <br />name/number issue generally, warrant Board consideration. For that <br />reason, the Community Development Department, based upon Chapter <br />951 standards and a recommendation from the Emergency Services <br />Department that road numbers should be used and assigned so as to <br />maintain the integrity of the 911 -EMS emergency response system, is <br />appealing the Planning and Zoning Commission's decision that the <br />Rosewood Court Subdivision be allowed to use road names instead of <br />road numbers. <br />12 <br />M <br />
