J N, 1i B": 912 <br />ti <br />The comprehensive bikeway sidewalk plan requires that a 5' <br />wide public sidewalk be provided along the project's 27th <br />Avenue frontage. The location of the proposed sidewalk is <br />subject to approval from the Florida Department of <br />Transportation which is currently formulating plans for the <br />subject area of 27th Avenue. However, at this time FDOT's <br />plans are not known. This leaves the applicant three options: <br />escrow funds for future construction of the sidewalk, <br />construct the sidewalk at the edge of the proposed 130' right- <br />of-way and grant a public access easement for the sidewalk, or <br />wait for the Florida Department of Transportation to finish <br />its plans to determine where to locate the sidewalk and <br />construct the sidewalk in that location. Regardless of which <br />option is chosen by the developer, the sidewalk must either be <br />constructed or escrowed for prior to the issuance of a C.O. <br />The final location of any sidewalk segment to be constructed <br />must be approved by the Public Works department prior to <br />construction. <br />The project site abuts 13th Street, an unpaved local road. <br />Section 952.08 of the LDRs requires that the project developer <br />provide for the paving of 13th Street in proportion to the <br />amount of frontage along 13th Street. In lieu of escrowing <br />37}$ of the cost of paving the entire 13th Street segment <br />abutting the site, the developer is proposing to completely <br />pave half of the project's frontage. This proposal is <br />acceptable to staff and satisfies section 952.08 requirements. <br />13. Concurrency: The concurrency certificate for this project has <br />been issued. <br />14. Specific Land Use Criteria: <br />a. No building or structure shall be located closer than <br />thirty (30) feet to any property line abutting a <br />residential use or residentially designated property; <br />b. Access shall be from a major thoroughfare unless <br />otherwise approved by the public works department; <br />C. Any accessory residential use, day care facility or <br />school upon the premises shall provide such additional <br />lot area as required for such use by this section and <br />shall further be subject to all conditions set forth by <br />the reviewing procedures and standards for that <br />particular use. Accessory residential uses may include <br />covenants, monasteries, rectories or parsonages as <br />required by these regulations; <br />d. Type "C" screening shall be provided along all property <br />boundaries where the facility is located adjacent to a <br />single-family residentially designated property. Type <br />"D" screening shall be provided along all property <br />boundaries when the facility is located adjacent to a <br />multiple -family residentially designated property. <br />The application satisfies all of the above criteria. <br />15.
