M M M <br />DATE: January 20, 1992 <br />SUBJECT: Vero Building Corporation's Request for Extension of the <br />Colonial Gardens Subdivision, Unit 21 Preliminary Plat <br />Approval <br />SD -90-08-11 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of January 28, 1992. <br />DESCRIPTION AND CONDITIONS: <br />On June 28, 1990, the Planning and Zoning Commission conditionally <br />approved a preliminary plat application submitted,by.Peterson and <br />Votapka, Inc., on behalf of the Vero Building Corporation, for the <br />Colonial Gardens Subdivision, Unit 2. Colonial Gardens <br />Subdivision, Unit 2, is a 43 lot single-family residential <br />subdivision located at the 1050 block of 9th Street, lying <br />immediately south of the Ridgewood Subdivision, west of Old Dixie <br />Highway, and directly north of the Colonial Gardens Subdivision, <br />Unit 1. <br />Peterson and Votapka, Inc., on behalf of the Vero Building <br />Corporation, has requested that a preliminary, plat extension be <br />granted. Due to permitting delays and financial conditions, the <br />applicant has been unable to commence construction of the approved <br />preliminary plat. The original preliminary plat approval for the <br />project formally expired on December 28,-1991; however, the request <br />for preliminary plat extension was received prior to expiration of <br />the approved preliminary plat. <br />The County adopted and implemented its new Land Development <br />Regulations (LDR's) in September of 1990. While some regulations <br />have changed, the changes are not significant enough to warrant <br />revisions to the project's design if it were reviewed as a new <br />application today. The members of the Technical Review Committee <br />(TRC) concur that the LDR changes that have occurred since the <br />initial project review and approval are not significant enough to <br />require any preliminary plat revisions. <br />aero Building Corporation is requesting a preliminary plat <br />pproval extension pursuant to the provisions of the Subdivision <br />and Plats Ordinance, Chapter 913. Pursuant to the Subdivision and <br />Plats Ordinance, the Board of County Commissioners may grant, or <br />grant with conditions, the requested preliminary plat extension. In <br />staff 1.s opinion, the existing, approved preliminary <br />application would substantially conform to current-requir entlat <br />s. <br />RECOlMENDATION: <br />Staff recommends that the Board of County Commissioners approve the <br />Vero Building Corporation's request for a one (1) time, eighteen <br />(18) month extension of the Colonial Gardens Subdivision, Unit 2, <br />Preliminary plat.
