O'Brien - Assistant County AttorneyvoQ <br />DATE: Janaury 8, 1992 <br />RE: PUBLIC HEARING 1/28/92 <br />CHAPTER 206 - HOUSING <br />Chapter 10 1/2 Housing (1974 edition) has been prepared for recodifica- <br />tion as Chapter 206 - Housing in the new Indian River County Code. <br />Staff recommends that Chapter 206 be adopted. <br />Chairman Eggert announced that the Affordable Housing Finance <br />Authority is recommending that this chapter be repealed. <br />County Attorney Vitunac explained that this Chapter presently <br />exists in our ordinances. In reviewing all the ordinances coming <br />into the new Code, staff is unanimously of the opinion that Chapter <br />206 is dangerous to have since it has not been put into effect. <br />This ordinance allows an independent housing finance authority to <br />be created and once it is created by the Board of County <br />Commissioners, it would be independent of the Board and it would be <br />out there much as the Housing Authority is. There would be two <br />housing agencies with a similar name, neither one of which would be <br />under the control of the County Commission. It was our thought <br />that since the Escambia County bond is out there in a pooled fund <br />right now for any needs that the county does have, there is no need <br />for this ordinance. There has been some confusion in the bond <br />market about the similarity in the names of the Housing Authority <br />and this one. In addition, Chairman Eggert has other plans that we <br />could put into Chapter 206 in the future if the Board decides to <br />create something under its own control for housing. <br />With regard to the trust, Chairman Eggert suggested that we <br />just have a committee recommend to the County Commission so that we <br />don't get into the bureaucracy of an independent district. <br />Attorney Vitunac advised that because this is in the wrong <br />form today to repeal it, he would have to bring this back to the <br />Board at an advertised public hearing. . <br />Chairman Eggert opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, she closed <br />the public hearing. <br />44 <br />
