meeting with Mr. Prince and Mr. Clem the day before the February 18 <br />vote, they informed him that they settled the suit. <br />Attorney Stone thought that was sufficient denial of the <br />specific allegations for the Board to make their determination. <br />Mr. Stone believed, and County Attorney Vitunac agreed, that an <br />affidavit under oath from Commissioner Scurlock would be sufficient <br />for any summary judgment proceeding or court proceeding. <br />Commissioner Scurlock agreed that he would submit a sworn <br />statement. This is an election year and anybody can make an <br />unsubstantiated accusation but a public official must take a stand <br />and he did not intend to go away. <br />Attorney Vitunac advised that staff is satisfied that we have <br />a valid contract with Guettler & Sons and will proceed with the <br />contract and prepare to defend the lawsuit against the County <br />Commission. The Board would not be required to take any action <br />unless the County receives an order from the court saying something <br />different. <br />Commissioner Bird hoped the lawsuit would not affect our time <br />table for construction of the golf course. <br />Attorney Vitunac thought that unless Prince is able to prove <br />something we are not aware of at the moment, an injunction is not <br />possible. The grant program is <br />administered by the United States Small Business Administration.
