_ � r <br />ON MOTION by Commissioner Bowman, SECONDED by <br />Commissioner Scurlock, the Board unanimously <br />approved and authorized the Chairman to execute <br />Change Order No. 1 to Work Authorization No. 3 with <br />Driveways, Inc., in the amount of $19,776.00, for <br />Water Main Replacement in Rockridge, as recommended <br />by staff. <br />CHANGE ORDER NO. 1 IS ON FILE IN THE OFFICE OF <br />CLERK TO THE BOARD <br />RIGHT-OF-WAY PURCHASE - KINGS HIGHWAY NORTH OF STATE ROAD 60 <br />The Board reviewed memo from Deputy County Attorney Will <br />Collins dated February 17, 1992: <br />TO: The Board of County Commissioners <br />FROM: k)e,- William G. Collins II - Deputy County Attorney <br />DATE: February 17, 1992 <br />SUBJECT: Right -of -Way Purchase - King's Highway North of S. R. 60 <br />Vero Beach Realty, Corp. is currently processing a rezoning application to <br />add 17.12 feet of commercial zoning to the north boundary of their property <br />at the northwest intersection of S.R. 60 and King's Highway, opposite <br />Ryanwood . This would constitute a node expansion which could not occur <br />without a comprehensive plan amendment were it not for the fact that an <br />equivalent acreage of land is proposed for deletion from the node for <br />right-of-way required for King's Highway. <br />The attached agreement would .bind Vero Beach Realty, Corp. to sell a strip <br />of right-of-way on the west side of King's Highway 40 feet by 540.45 feet or <br />.496 acres. The closing on the property would occur if and after the <br />rezoning request was approved but before the rezoning became effective by <br />filing with the Secretary of State. Compensation would be $23,674 of traffic <br />impact fee credits to any subsequent site plan approval for the Indian River <br />Square Shopping Center at this site. <br />The alternatives are to authorize the Chairman to execute the attached Letter <br />Agreement for purchase of the right-of-way, which would clear the way for <br />their rezoning request to move forward, or to decline the proposed <br />right-of-way agreement, in which case the rezoning request could not <br />proceed in the absence of a successful comprehensive plan amendment. <br />Commissioner Wheeler was concerned about extending this <br />commercial zone 17.12 feet closer to a residential area. <br />Attorney Collins confirmed it would cause the commercial <br />property to extend 17.12 feet into the RM -6 zone, bringing it that <br />much closer to Rivera Estates Subdivision to the north. <br />54 <br />
