r r � <br />Chairman Eggert understood this contract is a draft and the <br />details would be negotiated. <br />Assistant County Attorney Sharon Brennan explained that the <br />contract is an example of the contracts used in St. Lucie and <br />Martin Counties. Attorney Brennan reported the legal department <br />has been following this program in St. Lucie and Martin Counties at <br />the suggestion of Commissioner Wheeler and it seems to be working <br />well. She did a comparison of the fees paid in those counties with <br />legal costs in Indian River County and the result is that the <br />contract fees are far below what our average was in 1990. <br />Indications are that the number of cases as well as the cost per <br />case is increasing, so a contract of this sort would be cost- <br />effective for Indian River County. Attorney Brennan researched the <br />judges' reaction to legal representation by contract and the <br />feeling is that the representation is good for the most part. <br />Further, the contract does not bind the judges to hiring the <br />contracted attorney, and that is a good indicator. The contract <br />contains methods of terminating the contract quickly if it does not <br />work out. Attorney Brennan requested authorization from the Board <br />to continue her efforts in developing a contract and draft a <br />request for proposals which would be presented for the Board's <br />approval. Additionally, the Board should select a representative <br />to serve on the committee along with the Chief Judge of the 19th <br />Judicial Circuit, the Public Defender of the 19th Judicial Circuit, <br />and the County Attorney or a representative. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously selected <br />Commissioner Gary Wheeler to represent the Board on <br />the committee to draft a request for proposals and <br />an agreement to provide legal representation for <br />indigent adults and juveniles in Indian River County <br />as set out in staff's memo. <br />There being no further business, on Motion duly made, seconded <br />and carried, the Board adjourned at 12:12 o'clock P.
