If the developer has <br />to pursue a Comp Plan amendment, the County will have several <br />opportunities to review the request as well as the States and it <br />would have to go through three public hearings. Brennan - Assistant County Attorney 4E) <br />DATE: January 30, 1992 <br />SUBJECT: CONTRACT FOR SPECIAL APPOINTED PUBLIC <br />DEFENDER IN. NON -CAPITAL FELONY, MISDEMEANOR, <br />JUVENILE, MENTAL HEALTH, AND OTHER CASES <br />WHERE THE COUNTY IS STATUTORILY REQUIRED TO <br />PROVIDE FOR COURT-APPOINTED COUNSEL <br />_ Whenever the Public Defender cannot represent indigent adults or <br />juveniles due to conflicts, the trial judge appoints private counsel as <br />special public. defenders, with compensation to be paid by the county <br />pursuant to Administrative Order 78-2 at the rate of $40/hour for <br />out-of-court and $50/hour in -court services. <br />The Board of County Commissioners in St. Lucie and Martin Counties <br />have each contracted with one attorney or law firm to handle the <br />court-appointed work on a flat fee -per -case basis. This arrangement <br />has worked well and has proven to be cost-effective to the counties. <br />The contract cases do not include capital felonies. <br />If the Board gives conceptual approval to a similar contract for Indian <br />River County, a selection committee (comprised- of a designated <br />representative of the Chief Judge of the Nineteenth Judicial Circuit, a <br />representative of the Board of County Commissioners, the Indian River <br />County Attorney or representative and the Public Defender of the <br />Nineteenth Judicial Circuit) should be formed to draft a request for <br />proposals and an agreement to provide legal representation for indigent <br />adults and juveniles in Indian River County. These _draft documents <br />would be presented for the Board's approval. <br />The committee would then seek proposals from area attorneys, review - <br />the proposals and make a recommendation to the Board - -of. County <br />Commissioners. <br />58 <br />
