Cain, P.E. <br />County Engineer <br />Florida Department of Transportation <br />Reciprocal Fee Waiver Agreement <br />March 5, 1992 <br />DESCRIPTION AND CONDITIONS <br />The Florida Department of Transportation pursuant to Section <br />335.183 Florida Statutes and to Rule Chapter 19-46 State Highway <br />System Connection Permits -Administrative Procedure is allowed to <br />charge access fees for connection permits. The department, <br />however, has enacted Section 14-96.006 Florida Administrative code <br />which provides for the payment of a non-refundable fee for <br />department application processing, review and inspection of access <br />permits and provides that governmental entities applying for an <br />access permit are eligible for a waiver from the fee where the <br />other governmental entity has a reciprocal agreement to waive <br />permit fees with the department. The agreement before the Board of <br />County Commissioners implements this reciprocal fee waiver <br />arrangement. <br />It appears that any Florida Department of Transportation facility <br />built in this county would be eligible for a fee waiver. This <br />would include not only connection fees and normal permitting fees, <br />but also impact fees and possibly utility services fees. For that <br />reason we have sent this agreement on to the utility department and <br />to the planning department for their review and comment. From a <br />33 <br />MAR 17199 <br />
