Fr- 11 21 4 1992 -1 <br />BOOK <br />which will not expire until July 1st and the Coalition asked that <br />the lease be drafted so that the rental payments would not begin <br />until July 1st even though they would have access to the building <br />as soon as they provided insurance so they could do remodeling over <br />the first three months. The lease was structured so that rental <br />would begin July 1st but 12 months' worth of rent would be <br />compressed into a 9 -month period. The Coalition asked that the <br />first 3 months' rent be waived while they are in the remodeling <br />process and cannot utilize the building, and the Board will have to <br />decide whether to waive the first three months' rent. <br />Attorney Collins felt there was also a question about whether <br />we are to provide fully operational air conditioning and heating at <br />the $2 per square foot rental. <br />Chairman Eggert asked, and General Services Director Sonny <br />Dean responded that when we moved out of the building everything <br />was in good operating condition. Mr. Muller confirmed that his <br />maintenance people also stated that the air conditioning system is <br />in operating condition. He is not asking for an upgrade of the <br />systems but he stated that the two access doors to the air <br />conditioning room are deteriorated and need to be replaced. <br />The Board thought that was fair and Commissioner Bird agreed, <br />but he felt if there was a major additional expense, we may have to <br />readdress the price. Chairman Eggert clarified, and the Board <br />members agreed, that the air conditioning and heating systems will <br />be included "as is.11 <br />Attorney Collins pointed to Paragraph 11 of the lease which <br />allows the County to have a lien against all furnishings of the <br />lessee if they fail to pay rent. This would put a burden on the <br />subtenants in that if the Coalition fails to pay rent, a subtenant <br />potentially could be subject to a lien on the furniture and <br />equipment that they brought from other places. Attorney Collins <br />felt there were other protections in the lease, but he preferred to <br />keep the second sentence of Paragraph 11 about the County's rights <br />of foreclosure. <br />Attorney Collins led discussion regarding Paragraph 3.a., the <br />timing of rental payments, and Paragraph 3.d., the security <br />deposit, and the conclusion was that rental payments would be <br />monthly and the security deposit would be waived. After <br />discussion, the Board agreed to waive the rent for April through <br />June. <br />Mr. Muller commented that United Way is going to be there <br />filming the whole process. They see this as a community project <br />and a center for related agencies, and while United Way is not <br />funding any part of this project, they think it is a good project. <br />E-3 <br />
