McCoy, AICP /JOk <br />Senior Planner, Current Development <br />DATE: March 30, 1992 <br />SUBJECT: Extension of Windsor Properties Inc.'s Contract and <br />Posted Security to Guarantee Completion of Windsor Phase <br />I Required Subdivision Improvements <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of April 7, 1992. <br />BACKGROUND AND CONDITIONS: <br />At its regular meeting of January 22, 1991, the Board of County <br />Commissioners approved the Windsor Phase I final plat application <br />along with a contract to construct the required subdivision <br />improvements. To guarantee the construction the applicant posted <br />a $477,269.57 letter of credit (in the County's favor) which <br />expires April 10, 1992. The applicant, Windsor Properties Inc., <br />is now requesting that the County amend the original contract to <br />provide for a new expiration date of January 22, 1993, and a <br />$92,848.13 letter of credit to cover construction of the remaining <br />required improvements. <br />ANALYSIS: <br />All paving, drainage and utilities for Phase I have been <br />constructed by the applicant, and inspected and approved by the <br />County. The improvements yet to be completed include an 8' wide <br />bikepath along the project's western S.R. A.1.A. frontage, a 5' <br />wide public sidewalk along the project's eastern S.R. A.1.A. <br />frontage and vegetative plantings along the Jungle Trail. The <br />sidewalk and bikeway have been delayed due to permitting problems <br />with the Florida Department of Transportation (FDOT); it is <br />anticipated that these problems will be resolved in the near <br />future. While all of the Jungle Trail plantings have recently been <br />installed, the plantings have not been inspected or deemed <br />acceptable by county staff. The staff and applicant have agreed <br />that the County should retain funds sufficient to guarantee the <br />cost of the plantings until the survival of plantings can be <br />assured. <br />17 <br />BOOK <br />
