BOOR 85 <br />7 199 F:,,t <br />Alternatives <br />The Board of County Commissioners has several alternatives in <br />addressing the matter at hand. These include: <br />1. <br />Leaving county <br />regulations as they are, and thereby <br />prohibiting Mr. <br />Anthony's seafood retail outlet truck <br />operation in the <br />county; <br />2. <br />Modifying county <br />regulations to allow for the addition of a <br />transient merchant <br />classification for seafood sales (only): <br />3. <br />Modifying county <br />regulations to allow for the sale of any <br />types of products <br />as a transient merchant use; <br />4. <br />Modifying county <br />regulations to eliminate on-going transient <br />merchant operations, allowing only seasonal transient <br />merchants; or <br />5. Modifying county regulations to eliminate entirely the <br />allowance of transient merchants in the county. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners leave the <br />county's transient merchant regulations as they are, and thereby <br />prohibit Mr. Anthony's seafood retail outlet truck operation in the <br />unincorporated county. - <br />Roland DeBlois, Chief of Code Enforcement, advised that Mr. <br />Anthony was cited by the Code Enforcement Board for operating a <br />mobile retail outlet on U.S. #1 and Mr. Anthony is here today to <br />ask that his seafood sales be allowed. Staff's recommendation is <br />that the County's ordinance not be expanded to include the sale of <br />seafood and that the County's transient merchant regulations remain <br />as they are. <br />Commissioner Scurlock asked if we could eliminate the <br />particular aspect that these people are not paying their fair share <br />and have an unfair competitive advantage over those merchants who <br />operate from a permanent site and just consider the safety issue of <br />proper ingress and egress, traffic impact, significant signage and <br />adequate parking. Commissioner Wheeler understood the theory <br />behind allowing roadside fruit and vegetable stands was to <br />accommodate the people who wished to sell home grown citrus and <br />vegetables at roadside. He believed the roadside fruit and <br />vegetable stands should be looked at again since most of them do <br />not grow crops on their property but bring in produce from farmers' <br />markets. They aren't farmers, they are vendors. He thought that <br />not operating a permanent site gives them an edge over those <br />retailers who do. <br />38 <br />
