Attorney Vitunac felt we have a controverted testimony with <br />Dr. Branigan saying that the landscaper did it. If the landscaper <br />did the cutting on instructions from Dr. Branigan, then Dr. <br />Branigan would be responsible. If the landscaper did it on his <br />own, that is another thing. He believed in that case, the Board <br />could find the Branigans not in violation. <br />Commissioner Bird believed that the owners of waterfront <br />property have the responsibility to instruct their landscapers not <br />to cut mangroves under 7 -feet in height. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wheeler, the Board unanimously found the <br />Branigans not in violation of the mangrove trimming <br />provisions, but requested them to write a formal letter <br />to their landscaper indicating that they do not condone <br />the cutting, that they do not want this activity to occur <br />again. <br />PURCHASE OF EMERGENCY GENERATOR FOR GIFFORD MIDDLE 7 SCHOOL <br />FUNDING FROM GRAND HARBOR DEVELOPMENT ORDER FOR OFF-SITE SHELTER <br />The Board reviewed the following memo dated 4/10/92: <br />TO: James Chandler <br />County Administrator <br />THROUGH: Doug Wright, Director` <br />Emergency Services <br />FROM: John Ring, Emergency Management Coordinator <br />Division of Emergency Management <br />DATE: April 10, 1992 <br />SUBJECT: Purchase of Emergency Generator For Gifford Middle <br />Seven (7) School/Shelter - Utilizing Funding From <br />Grand Harbor Development Order For Off Site Shelter <br />-Lu JL5 respecmiully requested that the information contained herein <br />be given formal consideration by the Board -of County Commissioners <br />at the next regular scheduled meeting. <br />DESCRIPTION AND CONDITIONS: <br />The Board of County Commissioners approved a development for Grand <br />Harbor, now River Harbor, in Resolution No. 85-128. Paragraph 44 of <br />the development order provided a limit of 300 units to the issuance <br />of Certificates of Occupancy until such time as the developer <br />provided adequate emergency shelter space to accommodate existing <br />needs or an equivalent cash contribution to retrofit and upgrade an <br />existing shelter off site. <br />54 <br />
