1 <br />EPR28 2,, <br />��� v a fi� F ry <br />BOOK E <br />Section* 973.06(1) of the County Code requires that the cost of a <br />County nuisance abatement action shall be calculated and reported <br />to the Board of County Commissioners, who, by resolution, shall <br />assess such costs against the subject property. This matter is <br />presented herein to the Board for consideration to adopt said <br />resolution. <br />ALTERNATIVES AND ANALYSIS: <br />Section 973.06(1), Public Nuisances, of the Indian River Land <br />Development Code specifically reads as follows: <br />"After abatement of'a nuisance by the County, the cost <br />thereof .to the County as to each lot, parcel or tract of <br />land shall be calculated and reported to the Board of <br />County Commissioners. Thereupon, the Board of County <br />Commissioners, by resolution, shall assess such costs <br />against such lots, parcel, or tract of land. Such <br />resolution shall describe the land and state the cost of <br />abatement, which shall include an administrative cost of <br />seventy-five dollars ($75.00) per lot. Such assessment <br />shall be legal, valid, and binding obligation upon the <br />property against which made until paid. The assessment <br />shall be due and payable thirty (30) days after the <br />mailing of a Notice of Assessment, after which interest <br />shall accrue at the rate of twelve (12) per cent per <br />annum on any unpaid portion thereof." <br />Cost for equipment use and labor, as indicated by the Road & Bridge <br />Division, plus the $75.00 administrative cost, calculates to be: <br />Labor, Hauling & Dump Fee $ 625.00 <br />Administrative Fee: $ 75.00 <br />Total: $ 700.00 <br />RECONNENDATION: <br />Staff recommends that the Board of County Commissioners adopt the <br />proposed resolution assessing $700.00 in abatement cost, in <br />accordance with Section 973.06(1), of the Indian River County Land <br />Development Code. <br />Community Development Director Bob Keating further explained <br />that staff attempted to notify the owner by registered mail with <br />return receipt requested and have not gotten specific service by <br />that means, so they followed the alternate requirement in the <br />rules, which is to advertise in a public newspaper for 4 <br />consecutive times at one-week intervals. <br />Commissioner Bird noted that if the-County,'s actual cost took <br />advantage of the waiver of dump fees, the assessed costs should <br />reflect that. County Administrator Jim Chandler advised the waiver <br />is no longer in effect. <br />Commissioner Bowman stated that she had looked at the site and <br />felt the cost was reasonable for the tremendous load of trees that <br />were removed. <br />Commissioner Scurlock asked for confirmation that no one <br />representing the owner was in the audience. <br />M <br />
