L <br />MAY 9 1992 <br />BOOK D F',,UE 4 T <br />Ron Rennick, 501 Gardenia Lane, owner of an unplatted parcel <br />which lies directly east of the Indian River Mosquito Control <br />District property, wished to be excluded from this project because <br />in his opinion he will not specifically benefit since county water <br />has been available to his property for a couple of years from the <br />41st Street water line extension. <br />Commissioner Scurlock asked whether he had been assessed for <br />the 41st Street water line extension project, and Mr. Rennick <br />responded that the 41st Street project was an FHA project, and as <br />a federally funded project everyone paid for it. <br />Commissioner Scurlock asked, and Utility Services Director <br />Terry Pinto confirmed that Mr. Rennick was not assessed for the <br />41st Street project. <br />Mr. Rennick argued that the proposed water line extension will <br />not benefit his property because a water line could be placed from <br />41st Street, and he does not need water from two ends. <br />Commissioner Bowman pointed out that he has not contributed <br />his share to the 41st Street water line. <br />Mr. Chastain reminded the Board that this property was <br />assessed only to a depth of 150 feet along the 360 -foot frontage on <br />40th Street. County Attorney Charles Vitunac advised that Mr. <br />Rennick is benefitting from this line right now in the sense that <br />presently there is water available on the southern half of the <br />property. If he divided the parcel or otherwise sold it or split <br />it, the southern half would have water instantly. It is correct <br />that he can drop a line all the way from the north if he wants to, <br />but he must pay for the benefit he has now. <br />Commissioner Scurlock asked, and Utility Services Director <br />Pinto confirmed that the assessment is equitable. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously (4-1, <br />Commissioner Bird being absent) adopted Resolution <br />92-78 confirming the special assessments in <br />connection with a water line extension to Kings <br />Highway Subdivision and replat of Blocks 1, 2, 3, <br />and 4, 39th and 40th Streets east of Kings Highway, <br />and also 56th Avenue, as recommended by staff. <br />RESOLUTION 92-78, WITH PRELIMINARY ASSESSMENT ROLL ATTACHED, <br />IS ON FILE IN THE OFFICE OF CLERK TO THE BOARD <br />22 <br />
