TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien -Assistant County Attorney <br />U <br />DATE: May 13, 1992 <br />RE: INCREASE IN PENALTY FOR PARKING VIOLATIONS IN <br />DISABLED PARKING SPACES <br />The attached proposed ordinance was prepared after discussions with <br />Chairman Eggert on the general topic of disabled parking. A public <br />hearing date of June 23, 1992 is suggested. <br />TPO/sb <br />Chairman Eggert understood that a recent amendment to Florida <br />Statutes allows part of the fines that are collected to be used to <br />defray the expenses of the administration of the disabled parking <br />violations. <br />Assistant County Attorney Terry O'Brien advised that the <br />proposed ordinance will increase the penalty from $100 to $250, <br />which is the maximum allowed by state law. They anticipate that <br />funds collected under the current $100 penalty would continue to be <br />distributed according to Statute. Of the additional $150 penalty, <br />one-third would be used to defray expenses for the administration <br />and two-thirds would be used to provide funds for accessibility and <br />equal opportunity to qualified disabled persons and to provide <br />funds to conduct public awareness programs. In addition, these <br />funds could be used to fund a program similar to the one they have <br />in St. Lucie County where volunteers help enforce the handicapped <br />parking regulations. <br />Chairman Eggert understood that this will allow the Sheriff to <br />ticket a car and not just a person which is the case with the <br />present ordinance. <br />17 <br />MAY 2 1!_3��� <br />MOK, �"6 N_E 1 <br />J <br />
