Commissioner Scurlock asked if this is the standard <br />developer's agreement, and Attorney Vitunac explained that this is <br />the standard agreement we use for everyone. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously (4-0, <br />Commissioner Wheeler being absent) approved the <br />Developer's Agreement with Mr. Greg Palmer for the <br />construction of a sub -regional lift station at the <br />Palmer Trailer Park, as recommended by staff. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />MAINTENANCE MAP ON KING'S HIGHWAY NORTH OF SR -60 <br />The Board reviewed the following memo dated 5/ 20/92: <br />TO: The Board of County Commissioners <br />FROM: V71"' William G. Collins II - Deputy County Attorney <br />DATE: May 20, 1992 <br />SUBJECT: Maintenance Map on King's Highway <br />The Public Works Department has prepared a maintenance map for a portion <br />of King's Highway north of S.R. 60 which the county has constructed and <br />maintained uninterruptedly for at least four years. When a road constructed <br />by a county has been maintained or repaired continuously and <br />uninterruptedly for four years by the county, the road shall be deemed to <br />be dedicated to the public to the extent and width that it has been actually <br />maintained for the prescribed period, whether or not the road has been <br />formally established as a public highway. The dedication shall vest all <br />right, title, easement and appurtenances in and to the road in the county, <br />whether or not there is a record of conveyance, dedication, or appropriation <br />to the public use. (Florida Statute 95.361(1)(a)) <br />The filing of a maintenance map in the Office of the Clerk of the Circuit <br />Court, showing the land and reciting that the road is vested in the county <br />and duly certified by the Chairman and Clerk of the Board of County <br />Commissioners shall be prima facie evidence of ownership of the land by the <br />county. (F.S. 95.361(2)(b)) <br />RECOMMENDATION: <br />Authorize the Chairman and appropriate staff members to execute the <br />certifications on the maintenance map and file it for record in the Office of <br />the Clerk of the Circuit Court. <br />37 <br />MAY 2 61 ru <br />
