ORDINANCE 92- 24 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, AMENDING CHAPTER 306 <br />"MISCELLANEOUS OFFENSES" BY INCREASING <br />THE PENALTY FOR VIOLATIONS REGARDING <br />SPACES RESERVED FOR "PARKING BY DISABLED <br />PERMIT ONLY" AND PROVIDING FOR THE <br />DISPOSITION OF SAID PENALITY. <br />WHEREAS, Section 316.008 (4) , Florida Statutes provides <br />that a county may enact a fine for illegal parking in spaces <br />designated for the disabled, and <br />WHEREAS, said section specifies a fine not to exceed <br />$250.00, and <br />WHEREAS, a maximum fine should act as a deterrent to <br />Illegal parking in spaces properly marked, <br />NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA <br />that: <br />SECTION 1. AMENDMENT <br />A new Section 316.07.1 of the County Code is added to <br />read as follows: <br />Section 306.07.1 Fine for parking violation of spaces <br />a. <br />marked for disabled persons <br />The 'fine for the violation of Section 316.1955, Florida <br />Statutes, entitled "Parking spaces provided by governmental agencies <br />for certain disabled persons" or Section 316.1956, Florida Statutes, <br />entitled "Parking spaces provided by nongovernmental entities for <br />certain disabled persons" shall be $250.00 for each violation. <br />b. Pursuant to Section 316.008, Florida Statutes, a <br />separate county fund is established for the deposit of ' a portion of the <br />money realized by fines imposed pursuant to this section. The <br />portion of <br />said fine <br />that <br />shall be deposited is $150.00.
