Board of County Commissioners <br />May 2, 2016 <br />Page Two <br />Thus Medical Marijuana Treatment Centers will be required to obtain a permit from the Indian River <br />County Community Development Department. An application for a permit would have to include the <br />following information: <br />a. The name and address of the Medical Marijuana Treatment Center; <br />b. The name and address of each owner of the Medical Marijuana Treatment Center; <br />C. The name and address of the person who has been designated as the responsible physician; <br />d. The name and address of the person or entity which owns the real property upon which the <br />Medical Marijuana Treatment Center will be operated; <br />e. Proof that the applicant is currently registered as a Medical Marijuana Treatment Center, <br />pursuant to Article X, Section 29 of the Florida Constitution; <br />f. A sworn statement certifying that within the ten (10) years prior to submittal of the <br />application, neither the Medical Marijuana Treatment Center, nor any person identified in the application, <br />has been found to have acted with respect to controlled substances or marijuana in violation of applicable <br />law; and <br />g. A sworn statement certifying that the Medical Marijuana Treatment Center, and every <br />other pain management clinic or Medical Marijuana Treatment Center owned or operated by any person <br />identified in the application, will be operated in compliance with applicable law. <br />Additionally, a Medical Marijuana Treatment Center could not be operated in a manner which allows, <br />permits or encourages persons to loiter in or about the Medical Marijuana Treatment Center's parking <br />area. Also, a landlord or property owner cannot continue to lease property used as a Medical Marijuana <br />Treatment Center if the landlord or property owner knows or, through the exercise of reasonable care <br />should know, that the Medical Marijuana Treatment Center is being operated in violation of applicable <br />law. <br />Ordinances amending the land development regulations that change the actual list of permitted, <br />conditional, or prohibited uses within a zoning category must have a public hearing before the Planning <br />and Zoning Commission and two public hearings before the Board. Therefore, such proposed zoning <br />regulations will be addressed in a separate ordinance. That ordinance will be heard by the Planning and <br />Zoning Commission in August and could be brought to the Board for hearings in September and October. <br />As this proposed ordinance amends the Indian River County Pain Management Clinic and Controlled <br />Substances Ordinance, drafts of this proposed ordinance were circulated to the municipalities and the <br />Indian River County Sheriff's Office.
