DeBraal, Deputy- County Attorney <br />Kate Pingolt Cotner, Assistant Count}, Attorne}. <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: May 2, 2016 <br />SUBJECT: Ordinance Concerning Medical Marijuana <br />BACKGROUND. <br />Amendment 2, concerning medical marijuana, will be on the November 8 ballot. Amendment 2 is very <br />similar to the Amendment 2 considered in 2014, which failed to receive the requisite number of votes to <br />become part of the Florida Constitution. Amendment 2 proposes to amend the Florida Constitution to <br />allow for 1) the medical use of marijuana for individuals with debilitating diseases as determined by a <br />licensed Florida physician, 2) caregivers to assist patients' medical use of marijuana, and 3) the <br />Department of Health to register and regulate centers that produce and distribute marijuana for medical <br />purposes. <br />On April 5, 2016, the Indian River County Board of County Commissioners (the "Board") authorized the <br />County Attorney's Office to re -visit the zoning changes concerning medical marijuana that were proposed <br />in 2014. In response to the authorization granted by the Board, the County Attorney's Office drafted the <br />attached ordinance regulating medical marijuana. <br />The proposed ordinance incorporates the regulation of medical marijuana into existing Chapter 315 of the <br />Code of Indian River County, the Indian River County Pain Management Clinic and Controlled <br />Substances Ordinance. The definition of pain management clinics under Chapter 315 was expanded to <br />apply to Medical Marijuana Treatment Centers, which are those entities that acquire, possess, process, <br />transfer, transport, sell, distribute or dispense marijuana, products containing marijuana, related supplies, <br />or educational materials to qualifying patients or their caregivers.
