He felt that if we grant these <br />waivers in most cases, we may not need the ordinance. <br />Director Davis recounted that the Holland Law Center of <br />University of Florida, working with Federal Emergency Management <br />Agency (FEMA), developed the floodplain ordinance, and the language <br />of that ordinance was incorporated into our ordinance. It was <br />realized that the Indian River is a lagoon/estuary rather than the <br />classic narrow, less voluminous floodplain, and we allowed for <br />exemptions for small projects. Director Davis anticipated that if <br />a large project were proposed, staff would not recommend a waiver. <br />Commissioner Scurlock felt that many little waivers would add <br />up to a lot of displacement. <br />Director Davis explained that the alternative would be to not <br />allow any fill to be placed below elevation 4 along the Indian <br />River floodplain which would stifle even a single family home <br />development on a platted lot that is already created within that <br />area. He questioned whether we want to accomplish total <br />restriction. <br />Discussion ensued regarding the exemptions to the ordinance, <br />and Director Davis explained that St. Johns River Water Management <br />District does not apply their cut and fill balance within the <br />Indian River Lagoon. They did not recommend that we take it off <br />the books but rather look at it on a case by case basis, and that <br />was the recommendation staff made to this Board when the language <br />was put into the code. <br />There was further discussion and Director Davis explained the <br />process of recommending or denying waivers. After studying <br />calculations a determination is made to see what the effect of a <br />particular project will be on the overall Indian River floodplain. <br />Chairman Eggert asked, and Director Davis responded that there <br />were two larger projects which had to have minor cut and fill <br />balance waivers, but they were somewhat inland with a small amount <br />of river frontage. <br />Commissioner Bird felt that staff indicated they are handling <br />this proposed cut and fill project consistent with the way others <br />have been processed, and that is why they have made the <br />recommendation for waiver. <br />MOTION WAS MADE by Commissioner Bird, SECONDED by <br />Chairman Eggert, to approve Mr. Krovocheck's request <br />for a cut and fill balance waiver, as recommended by <br />staff. <br />18 <br />
